Apple-Broadcom Challenge to Caltech Patents Declined by US Supreme Court

The US Supreme Court on Monday declined to hear a bid by Apple and Broadcom to revive their challenges to Caltech data-transmission patents in a patent infringement case in which the university’s earlier $1.1 billion (nearly Rs. 9,000 crore) jury verdict against the companies was thrown out.

The justices turned away an appeal by Apple and Broadcom of a lower court’s ruling affirming a trial judge’s decision to prevent the companies from contesting the validity of the patents as they defended against the California Institute of Technology’s lawsuit.

The US Court of Appeals for the Federal Circuit, which specializes in patent cases, ruled against the companies’ arguments because they failed to bring them up during earlier proceedings at the US Patent and Trademark Office.

Apple and Broadcom have argued that they should have been allowed to raise the patent challenges during the trial.

A jury found that the companies infringed Caltech’s patents, ordering Apple to pay $837.8 million (nearly Rs. 6.900 crore) and Broadcom to pay $270.2 million (nearly Rs. 2,200 crore). The Federal Circuit took issue with the amount of the award, and sent the case back for a new trial on damages.

Caltech, located in Pasadena, California, sued Cupertino-based Apple and San Jose-based Broadcom in 2016 in federal court in Los Angeles, alleging that millions of iPhones, iPads, Apple Watches and other devices using Broadcom Wi-Fi chips infringed its data-transmission patents.

Apple is a major purchaser of Broadcom chips, and in January 2020 reached a supply agreement that ends in 2023. Broadcom has estimated that 20 percent of its revenue comes from Apple.

The Federal Circuit also upheld the trial judge’s decision to block the companies from arguing that the patents were invalid because they could have made the arguments in their petitions for USPTO review of the patents.

Apple and Broadcom told the Supreme Court that the Federal Circuit misread the law, which they said only blocks arguments that could have been raised during the review itself.

President Joe Biden’s administration urged the justices in May to reject the case and argued that the Federal Circuit had interpreted the law correctly.

Caltech has also sued Microsoft, Samsung Electronics, Dell Technologies and HP, accusing them of infringing the same patents in separate cases that are still pending.

Apple, Samsung Looking to Expand Production in India, Says MoS IT Rajeev Chandrasekhar

Apple and Samsung Electronics are among companies interested in increasing electronics production in India, a minister said, a boon for the country’s push to challenge neighboring China as a manufacturing hub.

The South Asian nation is seeking to expand its early success in smartphones to other product categories, Rajeev Chandrasekhar, India’s minister of state for technology, told Bloomberg TV’s Rishaad Salamat and Haslinda Amin on Friday. The country is launching a $2 billion (roughly Rs. 163 crore) plan to boost the local output of laptops, servers, tablets, and other electronics.

“We’ve had considerable success and tailwinds in the smartphone segment and we have increased interest from the likes of Apple and Samsung in expanding and growing here,” Chandrasekhar said. “We want to essentially replay that and add to that.”

India’s financial incentives for smartphone manufacturing have resulted in Apple and Samsung exporting billions of dollars of handsets from the country. The new IT hardware production-linked incentive plan has been drawn up for companies such as Dell Technologies, HP and Lenovo, Chandrasekhar said.

Prime Minister Narendra Modi’s government also wants to attract chip fabrication and chip packaging plants to India, he said. India is set to revive its effort to lure prospective chipmakers into the country as projects already disclosed, including billionaire Anil Agarwal’s $19 billion (nearly Rs. 1,55,330 crore) plan, are taking time to get off the ground, Bloomberg News reported this month.

Global PC Shipments Decline 16 Percent in 2022, Lenovo Secures Top Spot: Canalys

The global personal computer market witnessed a fall of 16 percent in 2022 as it battled a bad economic environment with rising energy costs and interest rates, as per a report by market research firm Canalys. The total shipments in 2022 were 285.1 million units. The total shipments of desktops and notebooks were down by 29 percent to 65.4 million units in the fourth quarter of 2022, though notebook shipments fell by 30 percent to 51.4 million units. Lenovo possesses the lion’s share of the worldwide PC shipment, followed by HP, Dell, Apple, and Asus in the top five positions. Global PC sales enjoyed massive growth during COVID-19 pandemic and the shipment volumes in 2022 are still favourable compared to the pre-pandemic period.

The report by Canalys said that total shipments of desktops and notebooks have declined by 29 percent to 65.4 million units in Q4 2022 in the backdrop of a global recession, increased inflation and higher interest rates. The total shipments in the whole year were 285.1 million units, marking a 16 percent drop as compared to the high demand in 2021 induced by the coronavirus pandemic that encouraged remote working. However, shipment volumes are promising as compared to the pre-pandemic phase, with total 2022 shipments 7 percent higher than in 2019.

The notebook shipments also fell by 30 percent to 51.4 million units in the last quarter of 2022 and 19 percent to 223.8 million units for the full year. While sales of desktops fell 24 percent to 14.1 million units in the fourth quarter and dropped 7 percent to 61.3 million units across the year.

In terms of market share, Canalys’s report shows that Lenovo continued to lead the market in the fourth quarter and full year. With shipments totalling 15.5 million units, the Chinese company grabbed a market share of 23.9 percent in 2022 with a 29 percent year-on-year decline.

HP remains the second larger contributor by shipping 13.2 million units and it faced a drop of 29 percent in Q4. In the full year, HP got a market share of 19.4 percent.

Dell, in the third position, faced a worse decline with a fall in shipments by 37 percent to 10.8 million units. Total shipments in 2022 were also down by 16 percent to 49.7 million units. The American-based company got 17.4 market share in the previous year.

Apple and Asus came in the fourth and fifth positions with 9.5 percent and 7.2 percent market shares, respectively, in 2022. As per the report, the Cupertino giant shipped 27.2 million Mac units in 2022, while Asus shipped 20.2 million units.

The Canalays report shows that all manufacturers in the top five positions saw a decline in shipments with Apple and Asus least affected.

Canalys said that the mute holiday season spending due to a bad economic environment, rising interest rates, slowdowns in hiring and expectations of a recession are intercepting demand for notebooks, desktops, and workstations.

Canalys Senior Analyst Ishan Dutt opined that the decline is especially stark as the corresponding period in 2021 brought about record shipments of notebooks and desktops. Vendors and retailers aimed to stimulate consumer spending with heavy discounting, but despite pockets of success, this was not enough to drive significant new sell-in. “With rising costs for energy and basic goods in key markets like the US and Europe, expenditure on big-ticket items like PCs has taken a back seat as consumers are prepared to delay refreshes. Meanwhile, on the commercial front, both public and private sector budgets faced tightening amid rising interest rates, slowdowns in hiring and expectations of a recession early this year,” he added.

The research company predicts that the PC market will witness recovery in late 2023, with momentum picking up in 2024. “This will be bolstered by an education demand bump in major markets as devices deployed during the pandemic peak reach the end of their life cycle. And even during the downturn, there will be areas that can deliver success for the industry, such as gaming, connected PCs and hybrid work, all of which were highlighted by announcements at CES 2023,” he added.

Global PC Shipments Fall 15.5 Percent in Q3 2022 Amid Weak Demand: Counterpoint

The global PC shipments of Q3 2022 has once again faced double-digit fall, according to a Counterpoint report. For the third quarter, the global PC shipments declined 15.5 percent YoY and reached 71.1 million units. This comes a quarter after the shipments faced the largest YoY decline since Q2 2013. In Q3 2022, major laptop brands like Lenovo, HP, Dell, Asus and others recorded a fall compared to the shipments registered in Q3 2021. However, Apple turns out to be the only PC brand among the top manufacturers to have excelled, as compared to the same quarter in the previous year.

A recent Counterpoint research has reported a 15.5 percent decline in the global PC shipments in Q3 2022. As reported, the PC shipments have reached 71.1 million units this year, even lower than the data recorded in the previous quarter. This surprisingly comes amid the season of peak consumer device sales.

The research firm has held weak demand, across both consumer and commercial markets, to be the reason behind the growing decline. Some other listed reasons for the low YoY data are shrinking enterprise purchasing due to economic uncertainty and increasing promotional events, impacting the PC revenue market, as per the research firm.

Individually, Apple is the only PC brand that has performed better this quarter with 7 percent YoY shipment growth. Meanwhile, HP has recorded the 26.5 percent YoY decline, highest among the other manufacturers. For this quarter, the company has a 18 percent share in global PC shipments with 12.7 million units.

On the other hand, Asus has faced a 9 percent YoY shipment decline in the quarter. Lenovo noted a 16 percent YoY decline. Dell, meanwhile, sold 12 million units, with 17 percent market share in the global shipments. Its YoY decline stands at 20 percent for Q3 2022.

Dell Mobile Connect App to Be Discontinued Globally in January 2023: Details

Dell is retiring its Mobile Connect app and it will soon be unavailable to download globally. The application is used to sync a smartphone’s text messages, calls, notifications, and more to a PC. It enables users to send text messages and make phone calls through their computers. The Mobile Connect application came pre-loaded on all Bluetooth-enabled Dell Inspiron, Vostro, G-Series, and XPS devices with Windows 10 or higher. Alienware computers get a reskinned version of this app named Alienware Mobile Connect, which offers the same functionality. This app is compatible with Android and iOS devices.

The support page of the Dell Mobile Connect app mentions that it will be delisted from its website on July 31 for all countries except the US, Canada, and Japan. The app will stop functioning later this year on November 30. Meanwhile, for the above-mentioned three countries, Dell Mobile Connect will get delisted on November 30 and will be discontinued next year on January 31.

Dell has also mentioned on the support page that it recommends users to uninstall the Dell Mobile Connect app before their regional discontinuation date. This would supposedly ensure an optimum device experience for the users.

To recall, the Dell Mobile Connect app was first showcased at CES 2018. It came pre-loaded on Dell laptops starting from January 2018. Apart from messaging and calling, the app features screen-mirroring functionality and can operate without the internet.

Global Tablet, Chromebook Shipments Decline in Q1 2022: IDC

Tablet and Chromebook shipments reportedly saw an annual decline in Q1 2022. This data comes from a report by the International Data Corporation (IDC). As per the report, the overall shipments continue to be above pre-pandemic levels, however, the overall growth has slowed down. This trend might indicate that the tablet and Chromebook markets are reverting to normality after experiencing a boom due to the pandemic. People worldwide supposedly made aggressive purchases in 2020 and 2021, which might have led to a more conservative approach in 2022.

As per the IDC report, the tablet shipments reached 38.4 million units during Q1 2022, which is a 3.9 percent year-over-year decline. Reportedly, despite the downward trend, several smartphone vendors like Realme, Oppo, Xiaomi, and more have entered the tablet segment. The high demand for tablets in new markets is expected to be the key propellant for this move by smartphone vendors. Apple remains the global leader in the tablet segment with a hold of 31.5 percent of the market share despite recording a decline of 4.6 percent. Samsung is in second place after experiencing year-on-year growth of 3.5 percent and holding 21.1 percent of the market share. Lenovo and Huawei rounded off the top 5.

Company 1Q22 Unit Shipments 1Q22 Market Share 1Q21 Unit Shipments 1Q21 Market Share Year-Over-Year Growth
Apple 12.1 31.5% 12.7 31.7% -4.6%
Samsung 8.1 21.1% 7.8 19.6% 3.5%
Amazon.com 3.7 9.6% 3.5 8.7% 6.3%
Lenovo 3.0 7.8% 4.1 10.1% -25.9%
Huawei 2.2 5.8% 2.7 6.8% -17.2%
Others 9.2 24.1% 9.2 23.0% 0.6%
Total 38.4 100.0% 39.9 100.0% -3.9%

The Chromebook market continues to plummet with a 61.9 percent YoY decline in Q1 2022. Contrary to the global trend, this market supposedly experienced growth in Asia/ Pacific regions (excluding Japan and China). This growth is purportedly credited to the large-scale investments made in the education sector. However, the overall growth might be caused due to the buildup of inventory and low demand. This inventory buildup is expected to clear out in the coming months, which might give a boost to this market segment. The top three Chromebook vendors for Q1 2022 were Lenovo, Dell, and Acer with 23.2 percent, 22.9 percent, and 22 percent market share, respectively. HP and Samsung rounded off the top 5.

Company 1Q22 Shipments 1Q22 Market Share 1Q21 Shipments 1Q21 Market Share Year-Over Year Growth
Lenovo 1.2 23.2% 3.4 25.7% -65.6%
Dell Technologies 1.2 22.9% 1.5 11.1% -21.1%
Acer Group 1.1 22.0% 1.9 14.1% -40.8%
HP Inc. 0.8 15.3% 4.4 32.8% -82.2%
