Adobe Sued by US Government for Hiding Fees, Making It Difficult to Cancel Subscription

The US government sued Adobe on Monday, accusing the Photoshop and Acrobat maker of harming consumers by concealing hefty termination fees in its most popular subscription plan, and making it difficult to cancel subscriptions.

In a complaint filed in the San Jose, California, federal court, the Federal Trade Commission said Adobe buries the fees, which sometimes reach hundreds of dollars, and other important terms in its “annual paid monthly” subscription plan in the fine print, or behind textboxes and hyperlinks.

According to the complaint, Adobe calculates early termination fees as 50 percent of the remaining payments when consumers cancel in their first year.

The FTC also said Adobe forces subscribers who want to cancel online to navigate unnecessarily through numerous pages, while those canceling by phone are often disconnected, are forced to repeat themselves to multiple representatives, and encounter “resistance and delay” from those representatives.

Two Adobe executives are also defendants: David Wadhwani, the president of digital media business, and Maninder Sawhney, a senior vice president in digital sales.

“Adobe trapped customers into year-long subscriptions through hidden early termination fees and numerous cancellation hurdles,” said Samuel Levine, director of the FTC consumer protection bureau. “Americans are tired of companies hiding the ball during subscription signup and then putting up roadblocks when they try to cancel.”

Dana Rao, Adobe’s general counsel and chief trust officer, said the San Jose-based company will refute the FTC’s claims in court.

“Subscription services are convenient, flexible and cost effective to allow users to choose the plan that best fits their needs, timeline and budget,” Rao said. “We are transparent with the terms and conditions of our subscription agreements and have a simple cancellation process.”

Subscriptions accounted for $4.92 billion, or 95 percent, of Adobe’s $5.18 billion of revenue in the quarter ending March 1.

The FTC accused Adobe of violating the Restore Online Shoppers’ Confidence Act, a 2010 federal law barring merchants from imposing charges, including for automatic subscription renewals, unless they clearly disclose material terms and obtain customers’ informed consent.

Monday’s lawsuit seeks civil penalties, an injunction against further wrongdoing, and other remedies.

The case is U.S. v. Adobe Inc et al, U.S. District Court, Northern District of California, No. 24-03630.

Adobe Photoshop to Get New Generative AI Features Powered by Firefly Image 3 Model

Adobe unveiled a new version of its Photoshop app for desktop on Tuesday, which now comes with new artificial intelligence (AI) features. Powered by its Firefly Image 3 foundation model, the third iteration of the company’s in-house text-to-image generation model, the new Photoshop will be able to generate images from text prompts directly within the app for the first time. The app is currently in beta, but the company has said it will be launched to all users later this year.

Making the announcement via a post in its newsroom, Adobe unveiled the new Photoshop for desktop app. The app was officially showcased at its Creativity Conference event. The new beta app comes with multiple new AI features such as Reference Image, Generate Image, Generate Similar, Generate Background, and Enhance Detail. The existing features such as Generative Fill and Generative Expand have also been improved.

The company also released a short video showcasing the capabilities of the new photo-editing software. The biggest addition with the new Firefly Image 3 model is the Reference Image. This feature allows users to upload an image as a reference to generate images. Users can also use the reference image on top of a generated image to enhance it further. The next big addition is the debut of text-to-image generation capabilities within the Photoshop app. Earlier, users could only use Generative Fill and Generative Expand inside the app.

Further, the Generate Background feature replaces and creates backgrounds, whereas Generate Similar generates different variations of an already generated image for granular control over the outcome. Apart from the AI features, Adobe has also added other tools such as Adjustment Brush for non-destructive adjustments to specific portions of images, an improved font browsing experience, and adjustment presets.

The company claimed that the Firefly Image 3 foundation model was only trained on licensed content such as Adobe Stock. To ensure the AI-generated images can be identified from real images, Adobe follows the Coalition for Content Provenance and Authenticity (C2PA) open standard which requires AI tool makers to add an AI label as well as to include details about its creation process within the metadata. In addition, it also follows the Adobe-led Content Authenticity Initiative (CAI) standard.

Google Pixel 8, Pixel 8 Pro Gain Adobe RAW Support for Lightroom, Photoshop

Google’s Pixel 8 series was launched earlier this year in October at the company’s Made by Google 2023 event. The Pixel 8 and 8 Pro already launched with the ability to shoot RAW photos. Adobe RAW compatibility has now been incorporated into Google’s Pixel 8 and Pixel 8 Pro, improving the photographic experience. Compared to JPEGs, RAW image files are richer in data, allowing users greater editing options. The new Adobe RAW support is set to be helpful for heavy image editing.

A support page, first spotted by 9to5Google, confirms that Adobe’s Lightroom and Photoshop apps now recognise Pixel 8 RAW files in Digital Negative Image (DNG) format. This compatibility covers files from the base Pixel 8’s primary sensor, wide-angle lens, and the front camera. Meanwhile, RAW support for photos taken with the telephoto lens is also available for the Pixel 8 Pro.

Pixel 8 series owners must have plug-in version 16.0.1 (at least) in order to use Adobe RAW support, according to the company’s support page. For best compatibility, it is best to confirm that Lightroom and Photoshop are updated to the most recent version. Other phones listed to offer Adobe RAW support include the iPhone 15, iPhone 15 Plus, iPhone 15 Pro, iPhone 15 Pro Max, Xiaomi 14, and Xiaomi 14 Pro.

Pricing for the Pixel 8 starts in India at Rs. 75,999 for the 8GB + 128GB option, while the Pixel 8 Pro is listed at Rs. 1,06,999 for the 12GB + 128GB variant. The base model is offered in Hazel, Obsidian, and Rose colour options. The high-end Pro model comes in Bay, Obsidian, and Porcelain shades.

The phones are powered by Google’s in-house Tensor G3 chip and Titan M2 security chip. They ship with Android 14 and supports Wi-Fi 6E, 5G, 4G LTE, Bluetooth 5.3, GPS, NFC, and a USB Type-C connectivity. The dual rear camera unit of the Pixel 8 includes a 50-megapixel Samsung GN2 sensor and a 12-megapixel ultra wide-angle camera. The Pixel 8 Pro, on the other hand, sports a 50-megapixel primary sensor, and two 48-megapixel sensors. Both phones are equipped with a 10.5-megapixel selfie camera.

Adobe, Figma Deal Faces EU Antitrust Probe Post Concerning Reviews

Adobe‘s $20 billion (nearly Rs. 1,65,550 crore) bid for cloud-based designer platform Figma could reduce competition in global markets for interactive product design tools and also shut out rivals, EU antitrust regulators said on Monday.

The European Commission said it opened a full-scale investigation into the deal after a preliminary review triggered concerns, confirming a Reuters story last month.

Tech deals have recently drawn sharp antitrust regulatory scrutiny amid fears that some bigger companies may be acquiring rival start-ups to shut them down.

Figma’s web-based collaborative platform for designs and brainstorming is popular among tech companies including Zoom Video Communications, Airbnb and Coinbase.

The deal would remove an important rival and could allow Photoshop maker Adobe to restrict competition in the global markets for supply of interactive product design tools, the EU antitrust watchdog said.

It said the acquisition could also affect Figma’s potential for growth into an effective competitor to Adobe’s asset creation tools and effectively reduce competition in interactive product design tools by bundling Figma with Adobe’s Creative Cloud suite.

“With our in-depth investigation we aim to ensure that users continue to have access to a wide pool of digital creative tools to choose from,” European Commissioner for Competition Margrethe Vestager said in a statement.

Adobe said it has received overwhelmingly positive feedback on the deal from customers worldwide.

“We remain confident in the merits of the case as Figma’s product design is an adjacency to Adobe’s core creative products and Adobe has no meaningful plans to compete in the product design space,” the company said in a statement.

“We look forward to establishing these facts in the next phase of the process and successfully completing the transaction.”

The EU competition enforcer said it would decide by December 14 whether to clear or block the deal.
