US Court Refuses Appeal to Revive Antitrust Lawsuit Against Meta’s Facebook

A US appeals court on Thursday refused to revive a lawsuit filed by states against Meta’s Facebook that alleged the company had broken antitrust law.

Dozens of states led by New York asked the US Court of Appeals for the District of Columbia last year to reinstate the lawsuit, which US District Judge James Boasberg of the District of Columbia rejected, saying they had waited too long to file.

Both the Federal Trade Commission and the states had asked the court in 2020 to order Facebook to sell Instagram, which it bought for $1 billion (nearly Rs. 8,120 crore)  in 2012, and WhatsApp, which it bought for $19 billion (nearly Rs. 1,55,330 crore) in 2014. The FTC case is going forward.

The three-judge unanimous appeals court panel said it agreed that “the states unduly delayed in bringing suit.”

“The States were on notice of Facebook’s two major acquisitions. Both were publicized,” Circuit Judge A. Raymond Randolph wrote, noting that the FTC had investigated both transactions.

Neither the New York attorney general’s office nor Facebook immediately responded to a request for comment.

In February this year, Meta registered another win as a judge released a ruling denying the Federal Trade Commission’s request to stop Meta Platforms from buying virtual reality content maker Within Unlimited, rejecting the regulator’s concerns the deal would reduce competition in a new market.

A December trial to decide if Meta could go forward with the relatively small deal was seen as a test of the FTC’s bid to head off what it sees as a repeat of the company acquiring small upcoming would-be rivals to dominate a market, this time in the nascent virtual and augmented reality markets.

Judge Edward Davila of the US District Court for the Northern District of California said the FTC had failed to show that Meta would have entered the market to make dedicated fitness content if it was unable to buy Within.

WhatsApp Working on Edit Message Feature With Dedicated Alerts on iOS: Report

WhatsApp has long been reported to be working on an edit message feature for all versions of its application. Like with deleted messages, an edited message will appear with an ‘edited’ label, visible to all participants in a chat. Reports since last year have suggested that work on this particular feature has been under development by the Meta-owned social media platform. Reports have suggested the feature being developed for both Android and iOS-run iPhone users. A new report suggests that the edit message feature is closer to seeing the light of day on iOS than ever before.

According to a report by WhatsApp update tracker WABetaInfo, the platform is working on the edit message feature for iOS beta testers to be rolled out in a “future update of the app.” The report states that the WhatsApp for iOS 23.6.0.74 beta version on TestFlight app now shows a dedicated alert for edited messages.

A preview from the update cited in the report shows a dedicated alert that prompts all participants in a chat that a message has been edited. The company will likely roll out the feature once all versions of WhatsApp that are incompatible with this feature have expired, and people will have to upgrade to the most recent edition of the app that can edit messages and receive edited messages.

The report also verified previous claims that WhatsApp will allow users to edit messages within 15 minutes of sending them and once edited, the message will appear in the chat with an ‘edited’ label.

WhatsApp is also reportedly developing a dedicated Audio Chat feature, which will likely appear within a user’s conversation window. Although not much about its functionality is known yet, but since this was spotted on a WhatsApp for Android beta, it is likely that the platform is also working on an iOS counterpart.

The popular social media platform also recently introduced two new updates to its WhatsApp Groups feature. One of the updates will enable the admins of each group to decide who can join and another will help users to search for a particular group in the sea of many by allowing them to search for any contact’s name and able to see the groups they have in common.

1.2 Crore WhatsApp Users, 17 Lakh Facebook Users Targeted in India’s Massive Data Theft

A massive data breach that has implications for national security was unearthed by Cyberabad Police here, who arrested seven people of a gang allegedly involved in the theft and sale of sensitive data of the government and important organisations, including details of 2.55 lakh defence personnel as well as the personal and confidential data of about 16.8 crore citizens across the country.

The accused persons were found selling more than 140 different categories of information, which include sensitive information such as details of defence personnel and the mobile numbers of citizens and NEET students, among others, Cyberabad Police Commissioner M Stephen Raveendra told reporters here on Thursday.

Seven data brokers were arrested from Delhi, police said adding that the accused had been operating through three companies (call centres) in Noida and other places. So far it has been found that the accused sold data to at least 100 fraudsters, who used it for committing cyber crimes. Investigations are still on, police said.

Sensitive data of defence personnel containing their ranks, email ids, place of posting, was found available with the accused, Commissioner Raveendra said.

“This will have serious national security implications. The data of defence and government employees can be used for espionage; to impersonate them and commit serious offences that may jeopardise national security. We are in the process of finding out how this data got leaked and who are the insiders who are doing it,” he added.

The arrested accused were selling the data through a contact details directory service provider and similar platforms, police said, adding that during the course of the investigation it was found that the accused had sold data of 50,000 citizens for as low as Rs. 2,000.

Notices will be sent to the service providers and they will be examined and legal action will be initiated against them also, police said.

“When any individual calls the toll-free numbers of service providers for any sector or category related confidential data of individuals, their query is listed and sent to that category of service providers. Then these fraudsters contact the clients and send them samples. If the client agrees to purchase, they make payment and are provided the data,” police said, explaining the modus operandi.

The accused had aggregated the data leaked from different organisations and, having registered themselves as service delivery agents, sold the data to cyber criminals, police said.

DCP (Cybercrime Wing) Ritiraj said a complaint was lodged with the Cyber Crime wing of Cyberabad Police about the sale and purchase of confidential and sensitive data, even as police had also been investigating how cyber criminals were getting access to data. Police have been working on the case for the past two months.

Deputy Commissioner of Police (Crimes) Cyberabad Police Kalmeshwar Shingenavar said that during investigations it was found that private organisations are collecting data both with consent and without the knowledge of individuals. There is no data privacy or protection policy offered by most of these private organisations who possess and process the data of individuals, he said.

The accused were also found selling information in categories such as Energy and Power sector, PAN card data, Government employees, Gas and Petroleum, HNIs (High Net-worth Individuals), demat accounts, student databases, women databases, data of people who have applied for loans and insurance, and credit card and debit card holders (of private banks), WhatsApp users, Facebook users, IT organisation employees, frequent flyers etc.

The data of NEET students, with their names, mobile number and their residential address, was also found with the accused. A PAN card database containing sensitive information on the income, email ids, phone numbers, address of citizens was also found.

As many as 1.2 crore WhatsApp users and 17 lakh Facebook users had also been targeted in the data theft, police said. Police also found data pertaining to two crore students, 12 lakh CBSE Class 12 students, 40 lakh jobseekers, 1.47 crore car owners, details of 11 lakh government employees and 15 lakh IT professionals among others.

Further, a mobile number database of three crore individuals, probably leaked from telecom service providers, was also found, the Commissioner said.

The sensitive data that has been leaked can be used for unauthorised access to important organisations and institutions. The data related to PAN card can be used to commit serious financial offences. It is being used to commit a large number of cyber crimes whereby the perpetrators gain the confidence of victims by disclosing such information, police added.

WhatsApp Update With Text Detection Support, Voice Status Rolling Out on iOS: All Details

WhatsApp has rolled out updates for iOS users that add new features to the popular messaging application. One of the features allows users to post voice status updates for contacts customised with privacy settings. Meanwhile, a subsequent update has added support for detecting text directly from images on WhatsApp for iOS. Even though both of these features have started rolling out to iOS users after the company tested the feature with users on the beta channel, some might have to wait after installing these updates to be able to use these features.

Spotted by WhatsApp feature tracker WABetaInfo, WhatsApp now allows iOS users to record a voice note and share it as a Status. To record, users must go to the Status tab, tap the pencil icon, and then long press the microphone icon to begin recording.

Voice notes shared as status updates are limited to 30 seconds in length, and users can also forward their own voice notes from chats to a Status. Support for voice Status messages has been added on WhatsApp for iOS 23.5.75, according to the feature tracker.

WhatsApp is also rolling out the feature to multitask during a WhatsApp call without pausing the video, as announced in the changelog for the WhatsApp for iOS 23.3.77 update. This update also includes the feature to detect and extract text messages directly from an image on the application. This is a feature that is supported on recent iPhone models such as the iPhone XS, iPhone XR, or later with iOS 15 or later, according to Apple.

Users who have updated to WhatsApp for iOS 23.5.75 may also be able to use this feature, as per the feature tracker. To test this feature, users can open an image with text and should find a new button that enables them to select and copy text directly from the image.

Meanwhile, WhatsApp beta 2.23.5.13 for Android has reportedly introduced Unicode 15.0 emojis. The official WhatsApp emoji picker has been updated with 21 new additions, available only to the beta testers at the moment.

The Meta-owned messaging service is also tipped to be working on a new text editor feature for the drawing tool, which will include new fonts and text formatting. It has simplified font selection by tapping the possible options on the keyboard. Users can also change text alignment and format text within images, videos, and GIFs and be able to change the colour of the text background.

WhatsApp Agrees to Be More Transparent Over Privacy Policy Changes, Says EU

Meta Platforms’ WhatsApp has agreed to be more transparent about changes to its privacy policy introduced in 2021, the European Commission said on Monday, following complaints from consumer bodies across Europe.

The European Consumer Organisation (BEUC) and the European Network of consumer authorities told WhatsApp last year that it had not clarified the changes in plain and intelligible language, violating the bloc’s laws.

EU members’ national regulators can sanction companies for breaches.

WhatsApp has now agreed to explain changes to EU users’ contracts and how these could affect their rights, and has agreed to display prominently the possibility for users to accept or reject the changes and ensure that users can easily close pop-up notifications on updates.

The company also confirmed that users’ personal data is not shared with third parties or other Meta companies, including Facebook, for advertising purposes.

“Consumers have a right to understand what they agree to and what that choice entails concretely, so that they can decide whether they want to continue using the platform,” Justice Commissioner Didier Reynders said.

Last month, Ireland’s Data Privacy Commissioner (DPC), EU’s lead privacy regulator, said that Meta must reassess the legal basis on how Facebook and Instagram use personal data to target advertising in the European Union and fined the social media giant EUR 390 million (roughly Rs. 3,500 crore) for the breaches.

The DPC, which is the lead privacy regulator for many of the world’s largest technology companies within the EU, directed Meta to bring its data processing operations into compliance within three months.

The penalties brought the total fines levied against Meta to date by the Irish regulator to EUR 1.3 billion (roughly Rs. 11,500 crore). It currently has 11 other inquiries open into Meta services.

The DPC said that as part of its decision, the EU’s privacy watchdog had purported to direct the Irish regulator to conduct a fresh investigation that would span all of Facebook and Instagram’s data processing operations.

WhatsApp Status Updated With Emoji Reactions, Voice Status, Link Previews and More Features: Details

WhatsApp on Tuesday introduced several updates to its status feature. These include advanced privacy settings to voice status, emoji reactions to statuses, and link previews on status updates. The company says it will roll out these features to users in the coming weeks. The new privacy option will let users choose who can see their status updates every time one is posted. The app has also rolled out the ability to share voice status updates for up to 30 seconds. WhatsApp users can now also respond to status updates by using emoji.

According to a blog post by WhatsApp, as many as five new features and improvements are coming to WhatsApp status including the ability to share voice status, new status profile rings, link preview on status and a more advanced privacy option. The new privacy option will enable users to update their privacy settings while posting a status and choose who can view their status every time they update it. The selected contacts will be used as the default for the next status.

Another feature announced by WhatsApp is the ability to record and share voice messages for up to 30 seconds on WhatsApp status. The app has also introduced the ability to respond to status updates by swiping up and tapping on one of eight emoji.

Additionally, the instant messaging app has also brought a new status profile ring that will inform users about status updates by their contacts. Whenever a contact updates their status, a ring will be displayed around their profile picture. It will be visible in chat lists, as well as group participant lists, and the contact info section.

Furthermore, users can now also preview a link shared in the status updates just like when they’re sent as a message within chats. WhatsApp has said that all these features have begun rolling out to users and should be accessible to all users in the coming weeks.

Google Messages Rolling Out WhatsApp-Like Delivery Indicators for More Beta Testers: Report

Google has expanded the beta testing of the WhatsApp-like delivery indicator feature for its Messages app. The tech giant started beta testing of the Google Messages delivery indicator in October 2022 and now it is available to more users. The indicators show up as a double check mark. Notably, the feature is currently rolling out to phones enrolled in the Google Messages beta program. Additionally, the messaging app owned by Google is also getting another feature dubbed ‘Create Your Profile,’ however, it is still under development.

According to a report by Android Police, Google is rolling out the new delivery indicators to more beta testers. As per the screenshot shared by the portal, Google Messages will show a single circular check mark indicator for sent messages whereas, for delivered messages, there’ll be two check mark indicators side by side. Additionally, these indicators will be shown filled after the text gets read.

The report noted that there is no information on the rollout of the stable version of the new features. Google started beta testing the new delivery indicators in October 2022 and now it is available to a wider audience. Google Messages currently has spelt-out ‘Sent’, ‘Delivered’, and ‘Read’ delivery indicators.

Apart from delivery indicators, Google Messages is also getting a new ‘Create Your Own’ profile feature, which is still under development. According to a report by SamMobile, Google Messages will allow you to create your own user profile. The profile page was discovered by Esper’s Mishaal Rahman (@MishaalRahman) in the app’s Settings menu. The feature, however, is currently not working. But once the feature will be live, Google Messages will let users create their own profile with a photo, name, and email address.

Meanwhile, Google has also announced end-to-end encryption for group chats on its Messages app. Notably, the new feature is being rolled out to Messages users enrolled in the open beta program in the coming weeks. E2EE messages are private and safe and can only be seen by the sender and the recipient. The group conversations with E2EE enabled will have a “This chat is now end-to-end encrypted” banner.

Meta Fined $5.9 Million by Irish Regulators for WhatsApp Data Protection Breach

Social media giant Meta has been fined an additional EUR 5.5 million (roughly Rs. 47.8 crore) for violating EU data protection regulations with its instant messaging platform WhatsApp, Ireland’s regulator announced Thursday.

The penalty follows a far larger EUR 390 million (roughly Rs. 3,429 crore) fine for Meta’s Instagram and Facebook platforms two weeks ago after they were found to have flouted the same EU rules.

In its new decision, the Irish Data Protection Commission (DPC) found the group acted “in breach of its obligations in relation to transparency,” the watchdog said in a statement.

In addition, Meta relied on an incorrect legal basis “for its processing of personal data for the purposes of service improvement and security,” the DPC added, giving the group six months to comply.

The fine was imposed by the Irish regulator because Meta — along with other US tech firms — has its European headquarters in Dublin.

In response on Thursday, Meta said it was opposed to the DPC decision and would look to overturn it.

“We strongly believe that the way the service operates is both technically and legally compliant,” a WhatsApp spokesperson said.

“We disagree with the decision and we intend to appeal.”

The breaches are similar to those explained in the regulator’s action against Meta earlier in January.

But the earlier decision also accused the Meta platforms of breaking rules over the processing of personal data for the purpose of targeted advertising.

In that instance the company, co-founded by social media magnate Mark Zuckerberg, was given only three months to respond to comply with the Irish regulator.

Meta announced its intention to appeal the 4 January decision, adding the regulatory ruling did not prevent targeted or personalised advertising.

The DPC said its more recent fine was considerably less because of a EUR 225 million (roughly Rs. 1,978 crore) fine imposed on WhatsApp for “for breaches of this and other transparency obligations over the same period of time”.

Thursday’s Whatsapp fine was also far lower because it did not relate to targeted advertising.

The Irish regulator had fined Meta EUR 405 million (roughly Rs. 3,561 crore) in September for failures in handling the data of minors, and EUR 265 million (roughly Rs. 2,330 crore) in November for not sufficiently protecting users’ data.

This latest round of fines follows the adoption of three binding decisions by the European Data Protection Board (EDPB), the EU’s data protection regulator, in early December.

The Vienna-based privacy group NOYB, which brought the three complaints against Meta in 2018, had accused the social media behemoth of reinterpreting consent as a civil law contract, which stopped users from refusing targeted advertising.

In reaction to Thursday’s news, NOYB criticised the “tiny” size of the latest fine — and slammed the DPC for ignoring how WhatsApp shares data within the group for advertising purposes.

“We are astonished how the DPC simply ignores the core of the case after a 4.5-year procedure,” said NOYB founder Max Schrems.

In October 2021, the Irish authority had proposed a draft decision that validated the legal basis used by the group and suggested a fine of up to EUR 36 million (roughly Rs. 316 crore) for Facebook and up to EUR 23 million (roughly Rs. 202 crore) for Instagram, over their lack of transparency.

France’s CNIL regulator and other European bodies disagreed with the draft sanction, which they considered to be far too low.

They asked the EDPB to judge the dispute with the EU data regulator deciding in their favour.

The EDPB has also asked the Irish regulator to investigate Meta’s use of personal data.

However, in its statement, the DPC pushed back saying the EU body does not have the power to “direct an authority to engage in open-ended and speculative investigation”.

The regulator said it will seek to annul the EDPB’s request before the European Union’s Court of Justice.
