Halyna Hutchins’ family vow to ‘fight’ after Alec Baldwin’s ‘Rust’ charges dropped

Alec Baldwin is still under the gun.

“Rust” cinematographer Halyna Hutchins’ family and widower plan to “fight to the end” and hold the actor responsible for her on-set death nearly three years ago — even after a New Mexico judge dismissed involuntary manslaughter charges against him. 

“This dismissal of the criminal case against Alec Baldwin is in no way, shape, or form an exoneration of him,” said powerhouse attorney Gloria Allred — who represents Hutchins’ parents and sister — outside the Santa Fe courthouse Saturday.

“It does not change the fact that Alec Baldwin killed Halyna Hutchins on the set of ‘Rust.’ It does not change the fact that he fired a loaded gun while pointing it at a human being,” she continued.

Baldwin, 66, was holding a prop gun on the ill-fated Western’s set on Oct. 21, 2021, when it went off and a live round fatally struck Hutchins and wounded director Joel Souza.

After several days of proceedings, Judge Mary Marlowe Sommer ruled on Friday that the charges against Baldwin should be dropped due to indications that the prosecution withheld crucial ammunition evidence from the defense.

Baldwin broke his silence on the court’s decision in an emotional Instagram post on Saturday afternoon.

“There are too many people who have supported me to thank just now,” the “30 Rock” alum wrote alongside a photo of himself in the Santa Fe courtroom.

“To all of you, you will never know how much I appreciate your kindness toward my family,” the father of eight added.

Allred said the family’s representatives “regret that the judge did not exercise any of the other options available to her, which would have allowed the criminal prosecution to proceed.

“While the judge’s decision to dismiss will be a devastating blow to Halyna’s family in Ukraine who mourn her death every day, we will continue to champion the truth that Alec Baldwin is responsible for Halyna’s death,” she said.

“We are dedicated to holding Alec Baldwin and the entire ‘Rust’  production accountable in our civil lawsuit, which is not affected by the decision of the judge in this criminal case,” the lawyer continued. 

“Actors do not have any special right to ignore gun safety guidelines. We all have a duty to each other to make sure that our workplaces are safe.”

Allred’s scathing takedown came after Hutchins’ widower, Matthew Hutchins, also vowed to hold Baldwin accountable for the tragedy.

“We respect the court’s decision,” attorney Brian J. Panish told The Post on Saturday on  behalf of the grieving husband. 

“We look forward to presenting all the evidence to a jury and holding Mr. Baldwin accountable for his actions in the senseless death of Halyna Hutchins,” Panish said in a statement first released to Deadline Friday night, shortly after the startling reversal.

Allred initially filed a lawsuit last year against Baldwin and others on behalf of Hutchins’ family in Los Angeles. Her law firm dropped that filing in June, and refiled in Santa Fe.

That lawsuit is still in the earliest stages, Variety reported.

Special prosecutor Erlinda Ocampo Johnson stepped off the case just moments before the shocking twist, and told NewsNation’s Chris Cuomo that she had no idea about the undisclosed evidence.

Based on her time on the case, however, Johnson added that she believed Baldwin did engage in “horseplay” with his prop gun that could be viewed as “reckless.”

“You don’t use another person as a target, as a human target, so that could potentially be reckless,” she explained.

On-set armorer Hannah Guttierez-Reed was convicted of involuntary manslaughter in connection with Hutchins’ death in March. Allred read victim impact statements from her heartbroken family during the sentencing phase.

“[Halyna’s father] said that he would like to see everyone who may be responsible for the death of Halyna have to face the consequences,” Allred told KOAT7 earlier this week, as proceedings against Baldwin got underway.

Guttierez-Reed was ultimately sentenced to 18 months behind bars – the maximum stay that awaited Baldwin if he was convicted of the manslaughter rap.

Matthew Hutchins previously settled a wrongful death suit with Baldwin for an undisclosed amount.

As part of the agreement, the widower was credited as an executive producer on “Rust,” which eventually finished filming in May 2023.

Baldwin – who is currently shooting a TLC reality show with his wife, Hilaria and their seven young children – was seen smiling Friday evening when he grabbed dinner at a Santa Fe restaurant.

The embattled star was dressed down in a black T-shirt and blue blazer when he arrived as he and his entourage – including his brother, fellow actor Stephen Baldwin, 58 – walked into the Casa Chimayo restaurant.

Despite Friday’s reprieve, Baldwin’s legal woes have already colored his high-flying lifestyle.

The three-time Emmy winner reportedly has a net worth of around $70 million, according to CelebrityNetWorth.com, but made headlines when he made a personal plea for potential buyers of his East Hampton house.

Baldwin listed the home in September 2022 – nearly one year after the “Rust” incident. 

The listing spent over a year in limbo before being pulled and then re-listed for nearly $19 million, or $10 million less than the original asking price.

He also owns a $10.3 million property in New York’s Greenwich Village and a $1.6 million farmhouse in Arlington, Vt.
